These Terms & Conditions (“Terms”) govern the SMS/MMS messaging program (the “Program”) offered by Oleksandr Kovalenko, sole proprietor registered in Canada, doing business as “AutoScale” (“AutoScale,” “we,” “our,” or “us”). By enrolling in or otherwise using the Program, you (“you” or “your”) agree to these Terms, our  Privacy Policy, and all applicable laws and regulations—including the U.S. Telephone Consumer Protection Act  (TCPA), Canada’s Anti‑Spam Legislation  (CASL), and the Australian Spam Act 2003.

1. Program Description

AutoScale sends text messages that may include appointment reminders, booking confirmations, service notifications, promotional offers, and other marketing or transactional content (“mixed messages”). Msg freq varies. No specific monthly minimum or maximum is guaranteed or required. Standard message and data rates may apply.

2. Opt‑In Consent

By entering your mobile number in a lead form on autoscale.online and checking the consent box (or by otherwise providing written consent), you (i) confirm you are the lawful owner or customary user of the mobile number provided; (ii) acknowledge that messages may be sent using an automatic telephone‑dialling system; and (iii) expressly consent to receive autodialled SMS/MMS messages from Oleksandr Kovalenko d/b/a AutoScale at the number you supplied. Consent is not a condition of purchase.

3. Opt‑Out, Re‑Enrolment, and Help

You may opt out of the Program at any time by replying STOP to any AutoScale message. After sending STOP, you will receive one confirmation text and no further messages. To re‑enrol, text START to our number or sign up again through our website form. For assistance, reply HELP or email [email protected].

4. Carrier Disclaimer and Charges

Standard message and data rates may apply according to your mobile plan and carrier agreement. Mobile carriers are not liable for delayed or undelivered messages.

5. User Responsibilities

You agree to notify us immediately if you change or deactivate your mobile number to prevent messages from being sent to a reassigned number. You must be at least 18 years old (or the age of majority in your jurisdiction) to enrol.

6. Privacy

We handle your personal information in accordance with our Privacy Policy. We do not sell, rent, or share mobile subscriber data with third parties for their own marketing. We may disclose such data only to trusted service providers strictly necessary to deliver text messages, under confidentiality obligations.

7. Modification or Termination

We may modify, suspend, or terminate the Program—or these Terms—at any time. Material changes will be posted at autoscale.online/terms_and_conditions with an updated Effective Date. Continued participation after changes constitutes acceptance of the revised Terms. We may terminate your enrolment without notice for any reason, including misuse or violation of these Terms.

8. Limitation of Liability

To the fullest extent permitted by law, AutoScale and its owners, officers, employees, agents, and service providers will not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to the Program. Our total liability to you for any claim related to the Program will not exceed fifty Canadian dollars  (CAD $50).

9. Indemnification

You agree to indemnify and hold harmless AutoScale, its owner, and its service providers from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Program.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict‑of‑law principles. Any dispute or claim arising under these Terms shall be resolved exclusively in the courts of competent jurisdiction located in Ontario, Canada, unless otherwise required by mandatory law.
